This website and the courses contained herein are operated and maintained by Healing Resonance, LLC and Kristi Borst dba Healing Resonance llc, a Maine limited liability company (“Healing Resonance llc and Kristi Borst”). The words “Us,” “We,” “Our” and "HR with KB" refer collectively to Healing Resonance llc and its officers, managers, members, and employees including Rev Kristi Borst, PhD.

In this Agreement, the term “use” refers to direct or indirect access, use, display, viewing, exchange, communication, reproduction, transmission or receipt of information, either with or without the aid of a machine or device, to, from or through the Website, private in-person or distance healing session, participation in group healing session, MP3 pre-recorded Kore Healing^SM session, video, and/or course, or any action that causes the performance of functions, activities or otherwise provides or obtains services, content, information, reports, materials or data in connection with the Services.

Our websites and healing sessions/offerings/options are not intended to directly or indirectly offer any medical advice!

We may also amend this Agreement at any time and from time to time, in our sole and absolute discretion. If you do not agree to any modification of the Agreement, you may terminate use of the services by contacting us via email at Kristi @ HealingResonance4.me (subj: TOS) to have your client registration expunged from the database(s).

4. Registered Users

4.1. You are not required to register in order to use our online booking system provided through AcuityScheduling.com. However, if you do, your access password is intended solely for your use. You shall not knowingly share your access password with others. You are solely responsible for maintaining the confidentiality of your access password. You are responsible for all activities and/or liabilities associated with your access password. You must immediately notify us of any unauthorized use of your password and you are responsible for any unauthorized use or charges incurred by any third party using your password until we receive written notification by you.

4.2. To become a registered user and in order for us to authorize you to use any portions of the services which are not generally available to the public, you will be required to provide us with certain information about you when registering. You represent, warrant and covenant to us that any and all information you do provide to us, is and will be true, accurate and complete when given to us, that in providing information to us you will not knowingly omit or misrepresent any material facts or information. We must and do otherwise reserve the right to approve or reject any user or revoke and restrict your right to use the services, at any time and for any reason in our sole and absolute discretion.

4.3. All purchases of programs, services and products on our websites must be made by adults 18 years of age or older. Sessions and products may be purchased for a minor by their parent or legal guardian; guardian must complete required Intake Forms prior to session(s).

5. Conduct and Proper Use of the Services

5.1. You may not use or allow, enable or facilitate others to use the services You may obtain, in any manner that:

(a) is libelous, defamatory, vulgar or obscene, pornographic, sexually explicit or sexually, racially, culturally, ethnically or otherwise actually or potentially offensive, harmful, harassing, threatening, hateful, objectionable, discriminatory or abusive;

(b) violates any state law, regulation or judicial or governmental order;

(d) infringes upon or violates any intellectual property, proprietary or rights of others; or

(e) is not reasonably related and in furtherance of the purposes and terms and conditions upon which Your use of the Services is governed and authorized.

5.2. You also may not use or allow, enable or facilitate others to use the Services You may obtain, in any manner that actually does or attempts to:

(a) disrupt, impair or interfere with, alter or modify the Website (including any information, content, materials, features or functions thereof), or the use of the Website by others;

(b) act in a way that affects or reflects negatively on Us, the Services or anyone else;

(c) collect or attempt to collect any information of another party, including without limitation personally identifiable information, without that party’s express prior consent. You agree to comply with all local, state, and federal laws, statutes, rules and regulations, as well as any international treaties, which are applicable to this Agreement, the performance of Your obligations and Your use of the Services.

5.3. The Website may contain references or links to other web sites, web pages, materials, information and resources (“Third Party Sites”). We are not responsible for and have no control over the accessibility via the Internet of any Third Party Sites. Furthermore, you understand, acknowledge and agree that We are not endorsing or otherwise responsible for or associated with any Third Party Sites and unless We specifically and explicitly tell You otherwise in writing, You should not assume or rely upon any information or content as having originated with or been approved by Us or even that We are aware of the specific content, information, features or capabilities available in connection with such Third Party Sites. We are not responsible or liable, in any manner whatsoever, for, in connection with or as a consequence of Your use of any Third Party Site, even if We are advised of the possibility that damages may result.

6. Your Information and Privacy

6.1. Our Web Site privacy policy is found on our Site Map page. Essentially, this site only collects information in the form of cookies to best guide our marketing efforts. Booking and payments are handled through secure third-party sites (currently AcuityScheduling.com and PayPal.com) which are independently responsible for their internal data collection and security.

6.2. When you schedule an appointment or use our Contact Us form, your email address and other contact information are used to send You administrative messages.

6.3. You agree that information, feedback, and testimonials conveyed to HR with KB either verbally, in emails, or in written form may be used in an anonymous way (First Name, State or Country if out of the USA) at Our discretion in marketing our Services to others. We are and shall be under no obligation (1) ask for additional permission; (2) to pay compensation for this information; or (3) to respond to any unsolicited comments on our Sites.You may request that we change First Name, State to (a) First Last only or (b)FL (First initial/Last initial), State or Country if out of the USA.

6.4. We reserve the right to disclose all information, including personal information, when required by law, court order or subpoena.

6.5. We will not sell or rent Your personally identifiable information such as Your email or postal address to third parties. All information, offers, promotions from third parties will first be selected and approved by Us and then be sent via Our site to You. You may opt out of Our communications at any time by responding to us or calling 207 216 0473.

6.6 When You purchase item(s) directly from Our site some may be sent from third party partners. This information will be transferred to the partner to deliver You the product and/or service. Our partners will be required to keep Your information confidential and secure. This does not include products or services from external linked partners or advertisers. Please review their terms and conditions and privacy policy.

6.7 Kristi values your privacy and understands that sharing your heartfelt concerns and health history helps deepen the connections that allow our work together. However, Kristi cannot fully guarantee the privacy of any personal health information communicated electronically via email, zoom, skype, phone, etc. There is always the option to send paperwork in advance of session date via snail mail. Contact Kristi for that address. Similarly, her session notes and communication to you may be conducted via first class mail per your request.

7. Courses and Copyrighted Artwork

You agree that with the exception of printable worksheets, You will NOT: Print, download, copy, record, or distribute/share any portion of the these Sites and Services without paying for this service or express written permission of the HR with KB.

8. Intellectual Property Rights

8.1. The Services and all text, graphics, images, logos, icons, programs, software, data, content, information, reports and materials made available to You in connection with Your use of the Services (including without limitation any aggregated, compiled or derived information or data which may contain or be aggregated, compiled or derived from, but does not identify the information or data You may have provided to Us), whether tangible and intangible in any form and on or in any media, and all intellectual property rights in and to the same (hereinafter the “Intellectual Property”), are proprietary to Us or are owned by Us or Our licensors or suppliers. You may not use the Intellectual Property, except as specifically permitted under this Agreement. You may not modify, copy, reproduce, republish, upload, post, transmit, publicly display, prepare derivative works from, reverse engineer or distribute the Intellectual Property in any way unless specifically directed to do so by Us during the Course. Any and all rights not expressly granted by this Agreement or specifically provided in the Intellectual Property, whether existing now or arising in the future, are hereby expressly reserved by Us.

8.2. We reserve the unconditional right (but not the obligation) to remove, move or edit any information, data, text, graphics, content or other materials which We consider to be in violation of any of the terms of this Agreement. We have no liability or responsibility to You or any other person or entity for performance or nonperformance of any such activities.

8.3 The content of the Website is provided by Healing Resonance llc. The content of the Website is provided “as is”, with no warranty or guarantee as to medical accuracy, appropriateness for medical use or otherwise. The Website is not to be considered or construed to be a replacement for or adjunct to medical advice. For medical advice, You should consult a healthcare provider in the field appropriate for Your condition or interest. Additional information is stated in section 2, above.

9. Indemnification

You agree to indemnify, defend and hold harmless Healing Resonance llc, Kristi borst, and service providers or employees, from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

In submitting an Intake Form, you agree to hereby waive and release Kristi Borst, Healing Resonance llc from any and all liability past, present and future relating to her services, whether they be onsite at the home of the client signing this consent or at another location. Except in the case of gross negligence or malpractice, you or your representative(s) agree to full release and hold harmless Energy Healer from and against any and all claims or liability of whatsoever kind or nature arising out of or in connection with siad session(s).

10. Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

11. Termination

We may terminate this Agreement and/or otherwise restrict, suspend or terminate Your use of the Services, in whole or in part, at any time in Our sole and absolute discretion, immediately and without notice or liability, with or without cause, and it will not limit any other rights or remedies which are available to Us or which may be available to You under any separate written agreements You may have entered into with Us. You may terminate this Agreement by providing Us with written notice of Your termination and ceasing to use the Services.

12. General

12.1. Limitation of Liability. Unless otherwise specifically provided in this Agreement, termination is Your sole right and exclusive remedy if You are not satisfied with the Services, Our services, reports, information, data, features, functions or capabilities You use or that We make or attempt to make available to You. Upon termination by You or by Us, Your right to use the Services shall immediately cease.

12.2. UNDER NO CIRCUMSTANCES WILL WE, HR with KB, or KRISTI BORST, BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR YOUR USE OF THE WEB SITE OR SERVICES, WHETHER BASED ON CONTRACT, TORT (STRICT LIABILITY OR OTHERWISE), INCLUDING WITHOUT LIMITATION: LOSS OF VALUE, LOSS OF USE, LOST ANTICIPATED PROFITS, LOSS OF DATA OR INFORMATION OF ANY KIND OR LOSS OF GOODWILL OR OPPORTUNITY, WHETHER OR NOT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGES. WE SHALL NOT BE LIABLE FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS, SERVICES OR TECHNOLOGY AND IN NO EVENT SHALL OUR LIABILITY TO YOU EXCEED THE AMOUNT OF LIQUIDATED DAMAGES SPECIFIED IN THIS SECTION. THE TERMS OF THIS SECTION WILL SURVIVE ANY TERMINATION OF THESE TERMS OF USE AND YOUR USE OF THE SITE OR THE SERVICES. THIS LIMITATION WILL APPLY REGARDLESS OF THE FAILURE OF THE ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.

12.3. No Warranties; Disclaimer. THE WEB SITE AND THE SERVICES ARE MADE AVAILABLE FOR YOUR USE ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF TITLE OR NON-INFRINGEMENT, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ANY WARRANTIES ARISING BY COURSE OF DEALING OR CUSTOM OF TRADE OR OTHERWISE. WE MAKE NO REPRESENTATION OR WARRANTY THAT THE WEB SITE OR ANY DATA, INFORMATION, MATERIALS OR CONTENT OR ANY PRODUCTS OR SERVICES CREATED, ARISING OR DERIVED THEREFROM, ARE ACCURATE, COMPLETE, APPROPRIATE, RELIABLE OR TIMELY FOR USE OR RELIANCE BY YOU OR ANY OTHER PARTY. WE ALSO MAKE NO REPRESENTATIONS OR WARRANTIES THAT THE SERVICES WILL MEET YOUR REQUIREMENTS AND/OR YOUR ACCESS TO AND USE OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, FREE OF VIRUSES, MALICIOUS CODE OR OTHER HARMFUL COMPONENTS OR OTHERWISE SECURE.

12.4. Governing Law: This Agreement is governed by and construed in accordance with the substantive internal laws of Maine without reference to its conflicts of laws principles.

12.5. Indemnification: You agree to defend and handle any third party claim or action against any subsidiary or affiliated company and any of its or their officers, directors, employees, agents, suppliers and licensees (the “Indemnities”), arising out of or relating to Your breach or alleged breach of any of the provisions of this Agreement or any other agreement You have entered into with Us in connection with the Services and their use by You. You further agree that You shall indemnify, defend and hold Us and the Indemnities harmless from and against any and all losses, damages, liabilities, fees and costs, including without limitation reasonable attorneys’ fees and court costs which may arise or are incurred by Us or any of the Indemnities in connection with any such claim or action. We may elect to participate in the defense of any such claim and negotiations for its settlement or compromise at Our own expense. No settlement or compromise that may adversely affect Our rights or legally obligate Us or any Indemnitee shall be made or entered into by You without Our prior written approval. We reserve the right, on written notice to You, to assume exclusive control of the defense and handling of any such claim or action, and all negotiations for its settlement or compromise, whereupon any further indemnification obligation under this section will end; provided, however, that Our defense or handling of any such claim or action shall not relieve You of any liability or responsibility in the event and to the extent any judgment rendered by a court of competent jurisdiction or order of any regulatory agency having jurisdiction over the subject matter of such claim or action finds that You have liability or responsibility.

13. Returns, Refunds, Expired Packages

Services, sessions, MP3s, artwork are provided without warranty and are sold "AS IS".

Discounted session/energetic support packages are sold for a specified number of sessions or number of days, WHICHEVER COMES FIRST. It is solely Your responsibility to ensure that you schedule all of your sessions before the package expiration date. You lose any discount on the sessions you have experienced when you abandon the full package to request a refund.

Intensive Caring Perspective Reboot® Healing includes up to 8 sessions plus a reasonable amount of text and email support between sessions OR energetic support for 4 months, whichever occurs first. The 3-session Jump Start package includes up to 3 sessions or energetic support for 3 months (or 6 months if that option has been selected) ... whichever comes first. It is your responsibility to schedule your sessions within the time-frame of your package. I am supporting you energetically, even if all sessions are not scheduled. Package may be extended or sessions can be added at your currently-discounted rate, at Kristi's discretion.

You may elect to terminate your package after the first or second session, as long as you are not within two weeks of package expiration date. Refund will be based upon NET package rate (excluding fees already paid to payment gateway) less number of sessions you've used @ the single-session rate, less a $10 admin fee. No refunds after the package end date.

In the case of buyer's remorse after booking a single session, refund will be based upon net amount after payment processing, less a $10 admin fee. All pricing is in US$. In-Person rates are based upon cash or check; credit cards are accepted buy client pays the $0.35 plus 3.1% credit card processor fees. There is a $35 fee for checks drawn on insufficient funds.

For all session types, there is a 24-hour cancellation policy. All clients can self-reschedule using the link in their booking confirmation email. If you have booked an in-person session and are experiencing COVID-19 symptoms, please contact me. The 24-hour cancellation policy will be waived in these situations. If you are merely feeling "under the weather", please wear a mask or let me know and I will wear a mask. When you are experiencing physical symptoms, it may be the best time for our work!

In-person package clients may elect to use any of their sessions as zoom/distance sessions, but there will be no adjustment to the pricing paid.
